Two lives were lost by the flood at Silver Street. Hawick had another historic landmark in the year 1767, besides the flood, for the Duke of Buccleuch raised an action in the Court of Session against the town of Hawick concerning the extent and limits of Hawick Common. This action was allowed to fall through by mutual consent, and referred to arbitration. The arbitrator being the Hon. James Montgomery, Lord Chief Baron of Exchequer, who, after ten years' negotiation, apportioned fourteen-twentieths to the town and sixtwentieths to the Duke of Buccleuch and other heritors. The arbiter decided that the Common Haugh and Myreslawgreen did not fall to be divided. The award bears date 24th May, 1777.
